Senate Judiciary Committee holds hearing on indemnification legislation

This morning the Senate Judiciary Committee heard testimony on HB 5466, a bill that prohibits a pubilc entity from requiring a contractor to defend the public entity or any other party from liability claims.

The bill would prohibit an indemnification agreement between a public entity and a contractor for an amount greater than the degree of fault of the contractor.

The League testified in opposition to the legislation.  We were joined by Abigail Elias, Chief Assistant City Attorney for the City of Ann Arbor. The committee did not vote on the legislation.
