The Michigan Municipal League\u2019s Jennifer Rigterink is our lead on the short-term rental housing issue and she\u2019s quoted extensively in the news piece.<\/p>\n<p>She explains how the state\u2019s housing crisis is tied to the short-term rental regulation involving sites like Airbnb and VRBO.<\/p>\n<p>\u201cI think what you\u2019re seeing especially in our high-destination areas is that there\u2019s starting to be a more intense amount of housing that\u2019s being taken off the market for vacation rentals, leaving less for individuals looking to buy a home or rent a home where they\u2019re going to live, or even an apartment,\u201d Rigterink told MiBiz.<\/p>\n<p>Granting short-term rentals a universal designation as a residential use via the pending <a href=\"https:\/\/www.legislature.mi.gov\/(S(n0c5veatcdld1ies0c0ilyvg))\/mileg.aspx?page=BillStatus&amp;objectname=2021-HB-4722\">House Bill 4722<\/a> could also create obstacles for <a href=\"https:\/\/www.michigan.gov\/mshda\/developers\/statewide-housing-plan\">Michigan\u2019s Statewide Housing Plan<\/a>, Rigterink added.<\/p>\n<p>\u201cI think anyone \u2014 the administration or legislators \u2014 talking about this issue needs to answer the question of: Do we have a housing issue in Michigan? Does that bill [HB 4722] help our housing issue or hinder it?\u201d Rigterink said.<\/p>\n<p>The <a href=\"https:\/\/www.michigan.gov\/mshda\/developers\/statewide-housing-plan\">Statewide Housing Plan\u2019s goals<\/a> for new units, new owners and rentals couldn\u2019t be achieved while competing with vacation rentals for housing stock, Rigterink argues.<\/p>\n<p>\u201cThere\u2019s no way we\u2019re going to be able to come close to any of those goals by also passing unfettered vacation rentals,\u201d she said. \u201cAll locals are asking for is the ability to balance housing stock for their residents and businesses as well as visitors.\u201d<\/p>\n<p><a href=\"\/inside208\/wp-content\/uploads\/sites\/3\/2022\/07\/STR-photo-for-art-1.png\"><img decoding=\"async\" class=\"lazyload alignleft size-medium wp-image-8788\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%27300%27%20height%3D%27200%27%20viewBox%3D%270%200%20300%20200%27%3E%3Crect%20width%3D%27300%27%20height%3D%27200%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"\/inside208\/wp-content\/uploads\/sites\/3\/2022\/07\/STR-photo-for-art-1-300x200.png\" alt=\"\" width=\"300\" height=\"200\" \/><\/a>The short-term rental issue is currently at a stalemate in Lansing after the <a href=\"https:\/\/www.legislature.mi.gov\/(S(n0c5veatcdld1ies0c0ilyvg))\/mileg.aspx?page=BillStatus&amp;objectname=2021-HB-4722\">disastrous HB 4722<\/a> was approved in the House and lingers in the Senate. The topic will likely becoming a Lame Duck issue toward the end of the year after the November election.<\/p>\n<p>As officials run for state offices in the upcoming August primaries and November general election and are out in the public at candidate debates, forums, open office hours, or are going door to door, be sure to get their stance on the attainable housing issue and HB 4722 that would allow up to 30 percent of a community\u2019s housing stock turned into short-term rentals. It\u2019s particularly important to explain that HB 4722 views short-term rentals as residential and not commercial properties. Also, it permits short-term rentals in all residential districts and the bill states short-term rentals can\u2019t be treated differently than other dwellings in the same district. Basically, the bill lays out that there\u2019s no difference between a place where someone lives and a place someone visits.<\/p>\n<p>This bill (<a href=\"http:\/\/blogs.mml.org\/wp\/short-term-rentals\/#legislation\">view our website with details here<\/a>) would make the housing crisis even worse because it would allow for corporations to come into a community and buy up multiple homes for the sole purpose of turning them into commercial businesses with a revolving door of part-time time, vacation-minded tenants in your neighborhoods. Under HB 4722, without any local regulations there\u2019s nothing to stop a neighborhood being overtaken by short-term rentals.<\/p>\n<div id=\"attachment_8767\" style=\"width: 254px\" class=\"wp-caption alignright\"><a href=\"\/inside208\/wp-content\/uploads\/sites\/3\/2022\/07\/STR-image-chart.jpg\"><img decoding=\"async\" aria-describedby=\"caption-attachment-8767\" class=\"lazyload size-medium wp-image-8767\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%27244%27%20height%3D%27300%27%20viewBox%3D%270%200%20244%20300%27%3E%3Crect%20width%3D%27244%27%20height%3D%27300%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"\/inside208\/wp-content\/uploads\/sites\/3\/2022\/07\/STR-image-chart-244x300.jpg\" alt=\"\" width=\"244\" height=\"300\" \/><\/a><p id=\"caption-attachment-8767\" class=\"wp-caption-text\">A look at the Good Neighbor legislation in comparison to other legislation proposing to regulate short-term rentals.<\/p><\/div>\n<p>The MiBiz article also details short-term rental legislation that the <a href=\"\/inside208\/2021\/10\/21\/short-term-rental-bills-introduced-good-neighbor-legislation-is-good-sense-compromise\/\">MML supports<\/a>, such as \u201cthe Good Neighbor Policy\u201d legislation \u2013 House Bills\u00a0<a href=\"https:\/\/www.legislature.mi.gov\/(S(5qnm5kzugcbq3dkc0uqporwt))\/mileg.aspx?page=getObject&amp;objectName=2021-HB-5465\">5465<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.legislature.mi.gov\/(S(5qnm5kzugcbq3dkc0uqporwt))\/mileg.aspx?page=getobject&amp;objectname=2021-HB-5466\">5466<\/a>\u00a0\u2013 that are supported by a coalition of organizations representing local government, public safety, the restaurant and lodging industry, economic development and more.<\/p>\n<p>House Bills 5465 and 5466 would amend the Michigan Zoning Enabling Act to allow all property owners to rent their property for up to 30 days a year in residential areas, create a statewide short-term rental database, establish safety standards, and ensure municipalities\u2019 right to regulate for health, safety and nuisance issues.<\/p>\n<p>As introduced, HB 5465 would also establish a 5 percent tax on short-term rentals that would split revenue between local governments and Michigan\u2019s tourism promotion program, which more traditional lodging options already contribute to.<\/p>\n<p>\u201cWe see that these really help balance those needs of the community as well as the rights of property owners,\u201d Rigterink told MiBiz.<\/p>\n<p>Despite the bipartisan effort of the 20 organizations behind the bills, the legislation has sat in a House committee for eight months without a hearing.<\/p>\n<p>The crux of the issue is whether short-term rentals are residential or commercial. Backers of HB 4722 want them to be classified as resident use, but the MML disagrees.<\/p>\n<p>\u201cWe\u2019re not saying that every single short-term rental is a commercial use.
