Proposed Permanent Rules Withdrawn"},"content":{"rendered":"<p>Yesterday, <span style=\"font-weight: 300\" data-contrast=\"auto\">Governor Gretchen Whitmer announced updates to the Michigan Occupational Safety and Health Administration<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">\u2019s<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">\u00a0(MIOSHA)<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">\u00a0<\/span><a style=\"font-weight: 300\" href=\"https:\/\/www.michigan.gov\/documents\/leo\/MIOSHA_COVID_Emergency_Rules_726100_7.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">COVID-19 emergency rules<\/span><\/a><span style=\"font-weight: 300\" data-contrast=\"auto\">\u00a0as many employers return to in-person work.\u00a0<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">The governor also announced an updated Michigan Department of Health and Human Services (MDHH<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">S)<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">\u00a0COVID-19\u202fGatherings\u202fand\u202fFace Masks\u202fepidemic<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">\u00a0order<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">, eliminating outdoor capacity limits and increasing indoor social gatherings to 50% capacity<\/span><span style=\"font-weight: 300\" data-contrast=\"auto\">, which is set to take effect on June 1.<\/span><span style=\"font-weight: 300\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<div>\n<p><span data-contrast=\"auto\">MIOSHA has updated other aspects of the emergency rules to reflect the recent\u00a0<\/span><a href=\"https:\/\/www.michigan.gov\/coronavirus\/0,9753,7-406-98178_98455-559589--,00.html\" target=\"_blank\" rel=\"noopener noreferrer\"><span data-contrast=\"none\">order from MDHHS<\/span><\/a><span data-contrast=\"auto\">\u00a0and guidance from the CDC. Those changes include:<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<\/div>\n<div>\n<ul>\n<li data-leveltext=\"\u00b7\" data-font=\"Symbol\" data-listid=\"1\" data-aria-posinset=\"1\" data-aria-level=\"1\"><span data-contrast=\"auto\">Employers may allow fully vaccinated employees to not wear face coverings and social distance provided they have a\u00a0<\/span><span data-contrast=\"auto\">policy\u00a0<\/span><span data-contrast=\"auto\">deemed effective to ensure non-vaccinated individuals continue to follow these requirements.\u00a0<\/span><\/li>\n<li data-leveltext=\"\u00b7\" data-font=\"Symbol\" data-listid=\"1\" data-aria-posinset=\"2\" data-aria-level=\"1\"><span data-contrast=\"auto\">The rules have been reformed focusing on performance, eliminating industry-specific requirements. Definitions have been updated to more clearly reflect changes in close contact and quarantining requirements for fully vaccinated employees.\u00a0<\/span><\/li>\n<li data-leveltext=\"\u00b7\" data-font=\"Symbol\" data-listid=\"1\" data-aria-posinset=\"3\" data-aria-level=\"1\"><span data-contrast=\"auto\">Cleaning requirements have been updated to reflect changes in CDC recommendations.\u00a0<\/span><\/li>\n<li data-leveltext=\"\u00b7\" data-font=\"Symbol\" data-listid=\"1\" data-aria-posinset=\"4\" data-aria-level=\"1\"><span data-contrast=\"auto\">Employers should continue to have and implement a written COVID-19 preparedness and response plan per the updated rules.\u00a0<\/span><\/li>\n<\/ul>\n<p><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:240}\">Also under the amended set of emergency rules, MIOSHA will remove the requirement that employers create a &#8220;Policy prohibiting in-person work for employees to the extent that their work activities can feasibly be completed remotely.&#8221;<\/span><\/p>\n<\/div>\n<p>The proposed permanent workplace rules set for a public hearing on May 26th have been withdrawn, and the hearing has been canceled.<\/p>\n<p>The Department of Labor and Economic Opportunity <strong>(LEO) will be hosting a webinar on the updated emergency rules today (May 25) at 2:30<\/strong>.
