{"id":5994,"date":"2018-04-27T10:37:03","date_gmt":"2018-04-27T14:37:03","guid":{"rendered":"http:\/\/blogs.mml.org\/wp\/inside208\/?p=5994"},"modified":"2018-04-27T10:37:03","modified_gmt":"2018-04-27T14:37:03","slug":"legislature-activity-commences-on-state-budget-government-immunity-and-more","status":"publish","type":"post","link":"https:\/\/mml.org\/inside208\/2018\/04\/27\/legislature-activity-commences-on-state-budget-government-immunity-and-more\/","title":{"rendered":"Legislature Activity Commences on State Budget, Government Immunity and More"},"content":{"rendered":"<p>Action in Lansing has been focused on positioning each chamber\u2019s version of the state budget for initial voting.\u00a0The full House and Senate Appropriations committees moved through their discussion and consideration of each subcommittee report during a series of meetings last week.\u00a0 Following that discussion and a small number of approved amendments, each subcommittee report was then combined into an \u201comnibus\u201d budget bill.\u00a0 <a href=\"http:\/\/www.house.mi.gov\/hfa\/PDF\/Bill%20Status.pdf\">The House finished their review and reported House Bill 5578, while the Senate finished their work on Senate Bill 848 this week<\/a>. House and Senate Democratic committee members attempted to amend their respective versions of the General Government budget to restore the current year revenue sharing amount at $6.2 million, but were unsuccessful at this initial step of the process.\u00a0 The House then passed their version over to the Senate this week, while the Senate versions will likely see action next week as they work to get the bills into position for final negotiations after the mid-May <a href=\"http:\/\/www.house.mi.gov\/hfa\/Consensus.asp\">consensus revenue estimating conference<\/a>.<\/p>\n<p><strong>Sexual Assault Package<\/strong><\/p>\n<p>The <a href=\"http:\/\/house.mi.gov\/MHRPublic\/CommitteeInfo.aspx?comkey=430\">House Law &amp; Justice committee<\/a> is continuing its work on the House-introduced package aimed at preventing sexual assault (<a href=\"http:\/\/legislature.mi.gov\/doc.aspx?2018-HB-5783\">House Bills 5783-5824<\/a>).\u00a0 The House\u2019s package has undergone committee consideration for the last two weeks and they are expected to continue testimony on these bills for at least another week.\u00a0 We expect the Senate package (<a href=\"http:\/\/legislature.mi.gov\/doc.aspx?2018-SB-0871\">Senate Bills 871-880<\/a>), that includes a significant change in government immunity and retroactive statute of limitations changes to be brought up by the House committee following their work on the House-originated package.\u00a0 League staff continues to meet with House committee members and other key legislators as we work with other governmental agencies and organizations to amend the Senate\u2019s government immunity bill (<a href=\"http:\/\/legislature.mi.gov\/doc.aspx?2018-SB-0877\">SB 877<\/a>) to protect local government from an unintended consequence where the Senate-passed language creates a higher liability standard than private sector employers.<\/p>\n<p><b>Stormwater<\/b><strong>\u00a0Utility Authority Proposal<\/strong><\/p>\n<p>The stormwater utility authority proposal that the League has been promoting (<a href=\"http:\/\/legislature.mi.gov\/doc.aspx?2018-SB-0756\">SB 756<\/a>) received a <a href=\"http:\/\/www.legislature.mi.gov\/(S(t4bikl4vj230h5nzhj3pfja2))\/mileg.aspx?page=committeemeeting&amp;objectName=2018-SCS-4d2abbe5-5d04-4e21-9414-5998b04960d3\">Wednesday hearing<\/a> in front of the Senate Natural Resources committee. League staff expressed our support for the bill and the committee heard direct testimony from the city of Birmingham, and Oakland County.\u00a0 While this hearing was testimony only, League staff continue to \u00a0meet with committee members to ensure a smooth path to passage for this important bill.<\/p>\n<p><strong>Asset Management Legislation<\/strong><\/p>\n<p>A three bill package (<a href=\"http:\/\/www.legislature.mi.gov\/(S(rsfqi1ehlkdis34tgicec4ad))\/mileg.aspx?page=getObject&amp;objectName=2017-HB-5335\">HB 5335<\/a>, <a href=\"http:\/\/www.legislature.mi.gov\/(S(rsfqi1ehlkdis34tgicec4ad))\/mileg.aspx?page=getObject&amp;objectname=2018-HB-5406\">HB 5406<\/a> and <a href=\"http:\/\/www.legislature.mi.gov\/(S(rsfqi1ehlkdis34tgicec4ad))\/mileg.aspx?page=getObject&amp;objectname=2018-HB-5408\">HB 5408<\/a>) based on the recommendations of the 21<sup>st<\/sup> Century Infrastructure Report received a hearing in the Senate on Thursday. HB 5335 would create the Michigan Infrastructure Council (MIC) to act as a clearing house for transportation and water asset data. The MIC will also focus on best practices for coordinated planning and creating policy recommendations to ensure proper investment in Michigan\u2019s infrastructure. HB 5406 creates the Water Asset Management Council (WAMC) \u00a0to collect asset management data on water, wastewater and stormwater systems.
