(<a href=\"http:\/\/www.mml.org\/newsroom\/press_releases\/2016-1-26-Roseville-Algonac-Dowagiac-Officials-Are-Among-Plaintiffs-in-Federal-Lawsuit-Against-Gag-Order.html\">View a press release<\/a> about the League plaintiffs in the lawsuit and <a href=\"http:\/\/www.mml.org\/newsroom\/press_releases\/2016-1-26-Civic-and-Education-Leaders-File-Lawsuit-Saying-Gag-Order-Law-Violates-US-Constitution.html\">view a statewide press release<\/a> about the suit.)<\/p>\n<p>Subsection 57(3) of Public Act 269, which amended Michigan\u2019s Campaign Finance Act, prohibits elected and appointed public and school officials from providing factual information to voters about local ballot measures within 60 days of an election. State law already prohibits governmental officials from using tax dollars to advocate for or against a proposal. This new gag order goes far beyond what is constitutionally permissible.<\/p>\n<p>\u201cIt\u2019s an absolute gag order preventing public officials from addressing their constituents and residents of about matters of local concern,\u201d said Scott Eldridge, an attorney with Miller, Canfield, Paddock and Stone who has filed the lawsuit against Public Act 269. \u201cIt\u2019s so overly broad and vague that it penalizes public officials with a crime if they speak in even an objectively neutral tone about ballot issues.\u201d<\/p>\n<div id=\"attachment_4906\" style=\"width: 310px\" class=\"wp-caption alignleft\"><a href=\"\/inside208\/wp-content\/uploads\/sites\/3\/2016\/01\/DSC_0327.jpg\" rel=\"attachment wp-att-4906\"><img decoding=\"async\" aria-describedby=\"caption-attachment-4906\" class=\"lazyload size-medium wp-image-4906\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%27300%27%20height%3D%27200%27%20viewBox%3D%270%200%20300%20200%27%3E%3Crect%20width%3D%27300%27%20height%3D%27200%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"\/inside208\/wp-content\/uploads\/sites\/3\/2016\/01\/DSC_0327-300x200.jpg\" alt=\"Tuesday's press conference.\" width=\"300\" height=\"200\" \/><\/a><p id=\"caption-attachment-4906\" class=\"wp-caption-text\">Tuesday&#8217;s press conference.<\/p><\/div>\n<p>The League hosted a press conference Tuesday afternoon to announce the lawsuit. The news conference was led by Board President and Dearborn Mayor Jack O\u2019Reilly and included some of the 18 plaintiffs named in the suit. In addition to being unconstitutional, the law will also negatively affect local credit ratings and result in higher costs for local taxpayers, Moody\u2019s Investors Service has warned.<\/p>\n<p>Algonac City Manager Doug Alexander said his city is requesting voters to allow the city to enter a 20-year lease agreement with the US Coast Guard for 200 feet of Riverfront Park dockage in exchange for the Coast Guard repairing at its cost the seawall at that location.<\/p>\n<p>\u201cUnder the current law we can\u2019t mail any information to voters about this lease agreement with the Coast Guard. For example, we would have normally explained a ballot issue like this in our quarterly newsletter that is mailed to about 1,900 city households,\u201d Alexander said. \u201cShould I expect a local group of citizens to get together and form a campaign committee to explain this to the voters? Not likely, nor should they have to. This is a function of government. People expect their local government to do these types of negotiations, put these questions before them and then share factual information with the public so that they can make educated decisions. Our newsletter would have just stated factual, objective and neutral information to our residents. It is a sad day when the state Legislature tells me that I can no longer communicate effectively with the people I was elected to serve.\u201d<\/p>\n<p>Here are some excerpts from a couple of the media reports:<\/p>\n<p><strong>From the\u00a0<a href=\"http:\/\/www.detroitnews.com\/story\/news\/politics\/2016\/01\/26\/officials-sue-state-ballot-info-law\/79358828\/\">Detroit News:<\/a><\/strong><\/p>\n<p><em>\u2026 the law violates the First Amendment to the U.S. Constitution by banning \u201cthe free flow of objectively neutral, core political speech,\u201d according to a complaint filed in U.S. Eastern District Court in Detroit.<\/em><\/p>\n<div id=\"attachment_4893\" style=\"width: 310px\" class=\"wp-caption alignright\"><a href=\"\/inside208\/wp-content\/uploads\/sites\/3\/2016\/01\/DSC_0301.jpg\" rel=\"attachment wp-att-4893\"><img decoding=\"async\" aria-describedby=\"caption-attachment-4893\" class=\"lazyload size-medium wp-image-4893\" src=\"data:image\/svg+xml,%3Csvg%20xmlns%3D%27http%3A%2F%2Fwww.w3.org%2F2000%2Fsvg%27%20width%3D%27300%27%20height%3D%27200%27%20viewBox%3D%270%200%20300%20200%27%3E%3Crect%20width%3D%27300%27%20height%3D%27200%27%20fill-opacity%3D%220%22%2F%3E%3C%2Fsvg%3E\" data-orig-src=\"\/inside208\/wp-content\/uploads\/sites\/3\/2016\/01\/DSC_0301-300x200.jpg\" alt=\"Attorney Scott Eldridge of Miller Canfield answers questions from the media during Tuesday's news conference.\" width=\"300\" height=\"200\" \/><\/a><p id=\"caption-attachment-4893\" class=\"wp-caption-text\">Attorney Scott Eldridge of Miller Canfield answers questions from the media during Tuesday&#8217;s news conference.<\/p><\/div>\n<p><em>The suit also contends the law violates the 14<sup>th<\/sup>\u00a0Amendment, which guarantees the right to due process, by subjecting public officials to criminal prosecution without providing adequate notice or guidance about what amounts to a violation.<\/em><\/p>\n<p><em>\u201cAs a result, it chills speech altogether,\u201d said Scott Eldridge, an attorney with Miller, Canfield, Paddock and Stone who is representing the plaintiffs.<\/em><\/p>\n<p><em>\u201cThis law was created by the Legislature in the dark hours of the night, and this kind of last-minute, knee-jerk policy making is exactly what continues to plague our great state,\u201d (said Warren Consolidated School District Superintendent Robert D. Livernois, a plaintiff in the suit). \u201cIn this particular case, that law resulted in the trampling \u2014 and I mean trampling \u2014 of our constitutional rights.\u201d<\/em><\/p>\n<p><strong><a href=\"http:\/\/www.mlive.com\/news\/index.ssf\/2016\/01\/local_education_leaders_sue_st.html#incart_river_home\">From Mlive.com:<\/a><\/strong><\/p>\n<p><em>The lawsuit alleges that the 60-day limitation violates the United States Constitution&#8217;s free speech protections, ensconced in the first amendment. Think about the fact that if I were to perform my duty as I have performed it over the last 18 years I would be subject to a fine, jail sentence and to charging with a misdemeanor, all because I tried to do my job,&#8221; Lyons said.<\/em><\/p>\n<p><strong><a href=\"http:\/\/www.freep.com\/story\/news\/education\/2016\/01\/26\/civic-education-leaders-fight-new-law\/79351362\/\">From the Detroit Free Press:<\/a><\/strong><\/p>\n<p><em>Douglas Alexander, Algonac city manager, said that while much of the attention is on ballot initiatives that have to deal with taxes, he&#8217;s concerned about what it will mean for a March 8 proposal in his community to approve a lease agreement with the U.S. Coast Guard for a section of the Algonac seawall.<\/em><\/p>\n<p><em>In the past, the city would have provided &#8220;factual, objective and neutral information&#8221; in its quarterly newsletter &#8220;so our residents could make an informed decision.&#8221;<\/em><\/p>\n<p><em>&#8220;Now, we can no longer do that,&#8221; Alexander said. &#8220;We would have explained that the Coast Guard would be paying for repairs.&#8221;<\/em><\/p>\n<p><em>Residents, he said, will have questions.<\/em><\/p>\n<p><em>&#8220;Should I expect every one of them to pick up the phone and call me? I hope not. But that&#8217;s the alternative we have now and it doesn&#8217;t make sense.&#8221;<\/em><\/p>\n<p><strong>From <a href=\"http:\/\/m.washingtontimes.com\/news\/2016\/jan\/26\/local-officials-sue-to-block-law-prohibiting-ballo\/\">the Associated Press<\/a>:<\/strong><\/p>\n<p><em>&#8230;But groups representing school districts, municipalities and other government entities said the \u201cfix\u201d pending in the House Elections Committee is inadequate and would only let them communicate the election date and a 100-word ballot summary of the proposal to voters.<\/em><\/p>\n<p><em>Dearborn Mayor Jack O\u2019Reilly, president of the Michigan Municipal League, said the secretary of state found only five valid complaints in three years of a local entity improperly advocating for a ballot measure.<\/em><\/p>\n<div id=\"ad-article\" class=\"ad\"><em>\u201cThere is no indication there was any great calamity to be solved\u201d by this law, he said during a news conference in Lansing to announce the suit. \u201cThis was a political thing that never should have happened.\u201d<\/em><\/div>\n<div class=\"ad\"><\/div>\n<div class=\"ad\"><em>Matt Bach is director of media relations for the Michigan Municipal League.
