{"id":10147,"date":"2017-12-12T18:13:41","date_gmt":"2017-12-12T22:13:41","guid":{"rendered":"http:\/\/blogs.mml.org\/wp\/inside208\/?p=5751"},"modified":"2017-12-12T18:13:41","modified_gmt":"2017-12-12T22:13:41","slug":"legislature-finalizes-action-on-opeb-bills","status":"publish","type":"post","link":"https:\/\/mml.org\/inside208\/2017\/12\/12\/legislature-finalizes-action-on-opeb-bills\/","title":{"rendered":"Legislature Finalizes Action on OPEB Bills"},"content":{"rendered":"<p>Following the <a href=\"http:\/\/blogs.mml.org\/wp\/inside208\/2017\/12\/07\/opeb-reform-efforts-scuttled\/\">initial action on the stripped down OPEB proposal last Thursday morning<\/a>, League staff and members reviewed that language with an eye towards identifying provisions that appeared to be in conflict with the<a href=\"http:\/\/www.michigan.gov\/documents\/snyder\/R3_Task_Force_Report_579101_7.pdf\"> task force report<\/a> or could be viewed as problematic for municipalities.<\/p>\n<p>We identified\u00a0a number of items and requested changes to accommodate those issues.<\/p>\n<p>Earlier this morning, before the House and Senate sessions began, we were provided an <a href=\"http:\/\/www.legislature.mi.gov\/documents\/2017-2018\/billconcurred\/Senate\/pdf\/2017-SCB-0686.pdf\">H-2 version of SB 686 <\/a>that did include a few of our requested changes, including:<\/p>\n<ul>\n<li>Some clarification of the municipal reporting requirements.<\/li>\n<li>Clarification that uniform assumptions established by the Treasurer are only for the purposes of the reporting within that section of the bill.<\/li>\n<li>Eliminating language that could have been viewed as requiring corrective action plans to focus only on &#8220;maintaining and preserving&#8221; benefits.<\/li>\n<li>Eliminating language which would have required these corrective action plans to address underfunding in ALL future years.<\/li>\n<\/ul>\n<p>We remain concerned with the potential for unintended consequences based upon how swiftly these bills were changed and moved, without a thorough legal or policy review.<\/p>\n<p>The <a href=\"http:\/\/www.legislature.mi.gov\/documents\/2017-2018\/billconcurred\/Senate\/pdf\/2017-SCB-0686.pdf\">substitute version of the main bill <\/a>(and its companions) moved\u00a0this afternoon, nearly unanimously in both chambers and the whole package is now on its way to the Governor.<\/p>\n<p><em>Chris Hackbarth is the League\u2019s director of state &amp; federal affairs.
